Please join us on Thursday, September 29, 2016 for a complimentary panel discussion and cocktail reception with Global Affairs Canada on The CETA Investment Court and the Future of Investor-State Dispute Settlement. The session will be presented by Fasken Martineau's Litigation and Dispute Resolution group and the

Canadian Council on International Law.

After feeling the heat from a number of NGOs, concerned citizens and governments, both Canada and the European Union have accepted a new international investment court system for resolving investor-state disputes. It would include an appeals process and stricter rules on impartiality and independence. This new initiative could have a profound effect on the future of investor-state dispute settlement, especially if it is adopted in more trade and investment agreements in the future.

Find out what the experts think in a panel discussion and Q&A session that touches on the following questions:

  • Will the investment court idea catch on as a new model for settling investor-state disputes?

  • Does design of the CETA investment court adequately respond to attacks on the legitimacy of ISDS?

  • What are the practical implications of the CETA investment court for parties to disputes?

  • How can we expect ISDS to evolve in the coming years - and should it exist at all?

  • Ljiljana Biukovic, (Associate Professor, Allard School of Law UBC; expert in international economic law and EU law)

  • Adam Douglas, (Counsel, Global Affairs Canada)
